Terms and conditions of Casa Maliyaa
Welcome to Casa Maliyaa. When you make a reservation/book with us, you automatically agree to our Terms and Conditions. We therefore ask you to read it carefully, but if there are any ambiguities, please let us know and we will explain them. The Terms and Conditions apply to all guests of Casa Maliyaa located at Pago Lomas de Cutar 235, Almachar. The owners are Danielle van Dam and Michel Arends, hereinafter referred to as Casa Maliyaa or La Casita, and live permanently on the estate.
1. General
1.1 Guests must have a permanent place of residence or residence.
1.2 Casa Maliyaa applies a minimum stay of 3 nights.
1.3 Check-in is from 3:00 PM to 10:00 PM and check-out is until 11:00 AM. This can be deviated from in consultation.
1.4 Later check-out is possible if the casita is not booked that same day. Additional charges may apply. In case of early departure, accommodation costs will not be refunded.
1.5 Casa Maliyaa is not liable for damage, loss and theft of personal belongings or valuables. Nor can it be held liable for accidents, injuries or illnesses that occur during the stay. In case of disputes, all (legal) costs are for the account of the guest.
1.6 The use of the swimming pool and other facilities of Casa Maliyaa is at your own risk. Casa Maliyaa cannot be held liable for bodily injury or damage to personal property through the use of the facilities.
1.7 Damage and loss of movable and immovable property belonging to Casa Maliyaa must be reported immediately by the guest. It will be determined in consultation whether compensation should be made. The owner of Casa Maliyaa takes the leading decision on this.
1.8 Casa Maliyaa can immediately deny and/or refuse guests access to Casa Maliyaa in the event of violation of the General Terms and Conditions and/or in the event of inappropriate behaviour, without further notice and/or statement of reasons and without refund of accommodation costs.
1.9 The Casa Maliyaa website has been compiled with the utmost care. To the best of our knowledge, the information on this page is correct, but in the event of incorrect information, no rights can be derived from such inaccuracies.
1.10 The administration of Casa Maliyaa is decisive in the event of a mutual difference of opinion.
1.11 Casa Maliyaa is an accommodation suitable for adults only.
1.12 Dogs are allowed on request. We charge a small fee per day.
2. Reservation, payment and confirmation
2.1 The reservation is only final after 25% of the total rent has been paid and confirmed by Casa Maliyaa.
2.2 For reservations (within) 6 weeks before arrival, the entire rent must be paid immediately.
2.3 Our booking confirmations refer to the General Terms and Conditions.
2.4 A reservation request can be made via the website of Casa Maliyaa or, if applicable, via an official booking site selected by Casa Maliyaa.
2.5 The accommodation costs in Casa Maliyaa must be paid in advance, via bank transfer.
2.6 In case of cancellation of your reservation, the cancellation conditions apply.
3. Rates
3.1 The rates shown on Casa Maliyaa are per night and based on two persons, including electricity, water, bed linen, towels, WiFi and final cleaning.
3.2 The current rates can be found on the website of Casa Maliyaa.
3.3 The rates include VAT according to the VAT rate applicable at that time.
3.4 The rates shown are subject to price changes.
4. Cancellation or No Show
It may happen that you have to cancel the holiday due to unforeseen circumstances. In that case, we apply the following cancellation conditions:
4.1 in case of cancellation up to 45 days before arrival: the deposit amount
4.2 in case of cancellation from 45 days before arrival: 100% of the total rent.
4.3 In the event of a No-Show, we will charge the full accommodation costs.
We advise you to take out a good travel and cancellation insurance.
5. Force majeure
5.1 Casa Maliyaa is not liable for non-performance or improper execution of the reservation/agreement, insofar as the shortcomings are not due to the fault of Casa Maliyaa or are the result of force majeure. Force majeure is understood to mean abnormal and unforeseeable circumstances that are independent of the will of the person who invokes them and the consequences of which could not be avoided despite all precautions.
6. Access Keys
6.1 As a guest of Casa Maliyaa you will receive a key to the gate and the entrance door to your accommodation. This must be returned on departure. As a guest, you are responsible for properly closing the entrance door of your accommodation and the gate. Loss of a key must be reported to the owner of Casa Maliyaa as soon as possible. The costs of the loss are the responsibility of the guest and must be paid in cash upon check-out.
7. Stay at La Casita/Casa Maliyaa
7.1 We do not charge cleaning costs and therefore we ask guests to leave the casita neat and (broom) clean. After the end of the period of stay, upon departure you must:
7.2 To have everything washed clean and put back in its place.
7.3 Have emptied rubbish bins.
7.4 Not to leave any food in the refrigerator.
8. Finally, a few house rules
8.1 Casa Maliyaa and our casita are completely non-smoking. If you want to smoke, you can do so outside on your terrace. Use the available ashtray for this. Smoking at the pool is not allowed. Be careful not to throw cigarette butts into nature. Nature is very dry and the risk of fire is high.
8.2 There is a relaxed and peaceful atmosphere in Casa Maliyaa and the surrounding area. It is therefore not allowed to play loud music at any time of the day.
8.3 It is not allowed to invite people to our premises during your stay.
8.4 If you want a drink at the pool, that is possible with the special plastic glasses that are present in the casita. It is not allowed to bring glass into the pool.
8.5 With its 300 days of sunshine a year, Andalusia is a wonderful place to stay, but it is also dry. It is therefore strictly forbidden to light a fire outside.
